Respect for Intellectual Property
Physician Prosperity, LLC (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), we will respond promptly to claims of copyright infringement committed using our website (PhysicianProsperity.com) that are reported to our designated copyright agent.
How to Submit a DMCA Takedown Notice
If you believe that content on our website infringes your copyright, please send a written notice to our designated agent (listed below) that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative list);
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our site (such as the URL);
- Your contact information, including your name, address, telephone number, and email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

How We Process Notices
Upon receiving a valid DMCA takedown notice, we will:
- Review the notice for completeness and compliance with DMCA requirements;
- Remove or disable access to the allegedly infringing material promptly if the notice is sufficient;
- Make a good-faith attempt to notify the person who posted or is responsible for the material (if applicable);
- Document the notice and our response for our records.
Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Physician Prosperity may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
If we receive a valid counter-notification, we may restore the removed material within 10–14 business days, unless the original complainant notifies us that they have filed a court action seeking to restrain you from engaging in infringing activity.
Repeat Infringers
In appropriate circumstances, we may disable or terminate access for users who are repeat infringers of copyright. This determination will be made at our sole discretion.
Misrepresentation Warning
Please be aware: Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be liable for damages, including costs and attorneys’ fees. Before filing a DMCA notice, please make sure you are the copyright owner or authorized to act on the owner’s behalf and that the use is not authorized or protected by fair use or other legal doctrines.
Scope
This DMCA Policy applies to content published on PhysicianProsperity.com. We do not currently host public user-generated content such as comments, forums, or reviews. However, this policy is in place to address any copyright concerns that may arise regarding content on our site, including content that may be uploaded through our contract analysis services.
